1. Introduction

These Terms of Service (hereinafter referred to as "these Terms") set forth the conditions governing the use of Latent (hereinafter referred to as "the Service"). By using the Service, users are deemed to have agreed to these Terms.

2. Description of the Service

The Service is a web application designed for the digital management of shooting logs, film stock inventories, photographic equipment, and images related to film photography.

3. Accounts

• Users are required to provide accurate information and to register an account.
• Users bear sole responsibility for the management of their accounts. In the event of any unauthorized use, please notify us promptly.
• The creation of multiple accounts by a single user is prohibited.

4. Fees

• The Service offers both free and paid plans. The details and pricing of each plan are set forth on the pricing page.
• Payment for paid plans is processed through Stripe.
• Cancellation is available at any time; however, no prorated refunds shall be provided.

5. Prohibited Conduct

Users shall not engage in any of the following activities:

• Conduct that violates applicable laws, regulations, or public order and morality
• Conduct that interferes with the operation of the Service
• Conduct that infringes upon the rights of other users or third parties
• Unauthorized access, reverse engineering, scraping, or similar activities
• Uploading illegal content through the Service
• Unauthorized use of the Service's name or branding

6. Intellectual Property Rights

• Copyright in content uploaded by users (including images and text) shall remain with the respective users.
• Users grant the Service a license to use such content to the extent necessary for the provision of the Service.
• All intellectual property rights in the Service's user interface, design, and software are reserved by the operator of the Service.

7. Modification, Suspension, and Termination of the Service

• The Service reserves the right to modify its content without prior notice.
• The Service may be temporarily suspended due to maintenance, technical failures, or other unavoidable circumstances.
• In the event of termination of the Service, users will be given reasonable advance notice.

8. Disclaimer of Warranties

• The Service is provided on an "as is" basis, and no warranty of fitness for any particular purpose is made.
• Except in cases of willful misconduct or gross negligence on the part of the Service, the Service shall not be liable for any loss or corruption of data.
• The Service shall not be liable for any issues arising from failures of third-party services (including but not limited to Supabase, Cloudflare, and Stripe).

9. Account Suspension and Deletion

• In the event of a violation of these Terms, the Service reserves the right to suspend or delete the user's account.
• Users may delete their accounts at any time through their account settings. Deletion of an account results in the permanent erasure of all associated data.

10. Amendments to These Terms

In the event of any material amendments to these Terms, users will be notified by email or through an in-app notification. Continued use of the Service following such amendments shall constitute acceptance of the amended Terms.

11. Governing Law and Jurisdiction

• These Terms shall be governed by and construed in accordance with the laws of Japan.
• Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
